I'm not an admin so can somsoen nominate this image...here's my reason:

The listed credit on the AP photo as listed on the NYT page is the same as the user on Wikipedia who uploaded it. however it isn't clear if the AP purchased the photo and now has rights to it or if merely distributed it and the photographer retains all rights to relicense. The byline says, "via the Associated Press" which suggests the latter. However we're not even sure if the photographer and the user are the same. hbdragon88 (talk) 03:49, 2 October 2011 (UTC)[reply]

I think, even if the AP had purchased rights from the author, that since a Creative Commons license is not revokable, we have every right, given by the author, to use this image according to its license. And frankly, if you compare the images, it looks like the AP just took this image, not the original, disregarding the derivative work. This should not be deleted, we have permission. They haven't used this derivative version. Their crop is not quite as tight, and the shirt has not been overexposed by the post-processing in their version. LX (talk, contribs) 17:58, 2 October 2011 (UTC)[reply]
