An appeal was takenand on May 31, 1898, the United States circuit court of ap-peals for the fifth circuit, afifirmed the ruling of the lowercourt. The city claimed the power to pass the ordinance fromfour sources. The claims were all disallowed, the courtholding: 1. The method of holding the helical springs is such that incase of breakage, they can be replaced by detaching thespring frame from the side bars; this is a new feature, andsuch repairs do not demand a pit or elevator. To detach the truck from the car the spring posts are re-leased from the brackets, which are riveted to the sill plate,and it is unnecessary to take out the bolts in the sill plate.
