Text Appearing Before Image:
e contained the attestationsof the various parties, together with any letters or docu-ments bearing upon the case. The defence of the prisoners was almost entirelyupon points of law. The murders could not be denied. The prisoners had been captured red-handed. Pom-pilias testimony was clear and unassailable, while anydoubt as to the share taken by the five men before theCourt was cleared up by their own confessions, extractedwhile they were under the torture. The lawyers for thedefence, indeed, concentrated all their forces upon theattaining of two objects—upon proving that the murderwas justified, on the one hand; and upon claiming anexemption from the death penalty, should the Courtdecline to accept justification, on the other. Arcangeli and Spreti argued that a husband wasjustified in killing an adulterous wife, and in thus wipingout with her blood the stain of infamy cast upon hishonour. They maintained that Pompilias adultery wasproved upon the following grounds: * Padua, 1685.80
Text Appearing After Image:
The Trial for Murder 1. Her fleeing from her husbands home with theyoung priest. 2. The love-letters which had passed between thetwo. 3. The fact that they were seen kissing one anotherin the carriage on the way to Perugia. 4. The fact that they occupied the same room at theinn at Castelnuovo. 5. The clandestine visits paid by Caponsacchi toPompilia while she was with her foster parents in Rome. 6. The sentence of the judge upon the two aftertheir arrest at Castelnuovo. To avoid repetition it may be well to give at oncethe answer of the lawyers on the other side to these sixpoints : 1. Pompilia fled from Arezzo because she was fullyconvinced that her life was in danger. She could notmake her way to Rome alone. She had consultedCanon Conti on the subject. He was a relative andfamiliar friend of the Franceschini, and it was he whohad advised the distressed woman to beg Caponsacchito conduct her to Rome. There is no trustworthyevidence to show that Caponsacchi ever went to theFranceschin
