On Friday morning, October 25th, 1895, General John H. Dickinson,counsel for the defendant, commenced the opening argument on behalfof the defense. The argument is in part as follows: Mr. Dickinson. May it please the Court and Gentlemen of the Jury,we are approaching the conclusion of a very long, interesting andimportant trial. The amount of testimony which we have taken, muchnecessarily of which has been immaterial, has been very great and aswe are all anxious to get through with the trial as rapidly as possible,

GEN. JOHN H. DICKINSON.One of Defendants Counsel. THE DURRANT CASE. 149 I shall proceed at once with my argument as to testimony which Ibelieve important and which bears upon the case. I will start with the morning of the 3rd of April and call attentionto the position and relations of the two principal actors in this tragedy.The defendant, a young man of the age of twenty-three, a man ofgood associations and unsullied character, and which after the con-clusion of the testimony still stands unsullied. My learned friends who opened for the prosecution yesterday madesome reference to unbridled passion and sensualism and sadism, butI challange the prosecution to point out one iota of testimony thatpoints in any manner or degree to the truth or even the suspicion ofthe existence of any such state.
