Summary[edit]

Description
English: Puerto Rican street artist Alexis Diaz recently teamed up with Chilean artist INTI to create a new mural for O.Bra Festival in Sao Paulo, Brazil. Their mural, which took over 1 week to complete, blends the two artist’s distinct imagery: Diaz’s detailed and crosshatched line work with colorful under layers, and INTI’s subjects inspired by life, death and religion, particularly Christianity. It features a surreal split-image of a skeletal robed woman, crowned with flowers and holding up a mechanical-like heart. She is a familiar figure in INTI’s other works, who uses a warm color palette to paint characters representing his Latin culture. Diaz and INTI’s mural was painted just in time for the Brazilian public holiday of Day of the Dead, which was celebrated on November 2nd 2015. Similar to other Day of the Dead celebrations, people go to cemeteries and churches with flowers and candles, and offer prayers. The celebration is intended as a positive honoring of the dead, echoed in the spirit of Diaz and INTI’s piece. At his Facebook, Diaz wrote: ” [I] have the pleasure to enjoy every second of the process along with a great friend, and see the end result of something that was born as natural and fluid, it fills the heart! Very fortunate to have the opportunity to express what I think and feel through art and be able to get it into a wall and more in a big city like Sao Paulo!” [1]

The photographical reproduction of this work is covered under the article 48 of the Brazil copyright law, which states: Works permanently located in public places may be freely represented by painting, drawing, photography and audiovisual processes.

Warning: FoP is allowed in Brazil, including commercial use, to some extent. Artworks placed in locations with access to the public can be freely represented by photography, painting, drawing and audiovisual means. Commercial use is allowed, as long as the artist's work is properly attributed, the representation does not consist in a reproduction. The existing jurisprudence consistently allows commercial use of artworks under FoP, as long as the artwork is accessory, and not detached from its surrounding elements, and therefore not unfairly used to produce revenue that by law belongs to the artist. Violation of those rights is frequently punished by Brazilian courts with pecuniary indemnisations to the offended party.
