Description

Amidst bitter controversy and protest the Homosexual Law Reform Bill was passed on 9 July 1986, and enacted a month later on 8 August. The Bill overturned a long history of opposition to sexual activity between men in New Zealand, and an equally long history of legislation that criminalised this activity.

Throughout the 1940s and 1950s men found guilty of sodomy could still be flogged or whipped, and serve their imprisonment terms with hard labour. Protests, petitions and other grassroots actions against such laws gained traction from the 1960s onwards. In 1968 the New Zealand Howard League for Penal Reform presented a petition to parliament recommending a number of justice reforms. These included the that ”homosexuality between consenting adults in private should no longer be a criminal offence”.

The record above is from a Cabinet Office file relating to petitions, and refers to Parliamentary Petition No. 8/1968 submitted by the New Zealand Howard League. Although the majority of the petition was passed to Government for consideration, this did not include section (j) which called for the decriminalisation of homosexuality. It would take another 18 years for this goal to be achieved.

The Homosexual Law Reform Bill decriminalised sexual relations between men aged 16 and over. No longer would men having consensual sex with each other be liable to prosecution and a term of imprisonment. Though sex between women had never been illegal, many lesbians suffered the same social discrimination as gay men and were staunch supporters of the reform movement.
