Summary[edit]

Description

Under a judicial system that separates chancery and equity pleadings, it's natural that there be some rivalry between the two regimes. Though the strict separation has been mostly abolished in the United States, the influence of this state of the law when this paper was written still resonates. George Palmer Garret writes to us about the weaknesses of the chancery as compared to equity in an effort to strengthen the system, saying "The Common Law has plagiarized many things from Chancery. It is only fair that Chancery should borrow now from the Common Law to amend its own deficiencies." His suggestions include, 1) explicit, specific, and pleadings; 2) require ruling on evidence when it is submitted; 3) have the judge in the courtroom during testimony rather than relying on the record; and 4) do not allow interlocutory appeals.
